Booking Terms and Conditions

1. Organiser and applicability 
1. These Travel Terms apply to package travel agreements concluded  by the organiser, with you as the traveller. 
2. The organiser may make the conclusion of the package travel  agreement conditional upon your taking out travel insurance and  may also ask you to demonstrate that you have done so. 
3. The agreement qualifies as a package travel agreement. The  organiser is responsible for the proper performance of the travel  services included in the agreement, even where those services are  performed by third parties. 
4. The traveller is entitled to the rights set out in the Package Travel  Directive. Traveller can take note of The Key rights under Directive  (EU) 2015/2302 before booking given that these fundamental rights  are set out at the end of these terms and conditions.  
5. The following items do not form part of the package travel and are  arranged and paid for by the traveller: 
• the outbound and return flights and other international transport; 
• visas and other travel documents; 
• travel insurance, health insurance and cancellation insurance; 
• personal expenses and services not expressly included. 
6. The organiser is not responsible for the performance,  modification, cancellation or delay of transport booked independently by the traveller or of insurance policies taken out independently by the traveller.

 

 
2. Travel programme and agreement
1. The travel programme, booking confirmation, quotation and these  Terms together constitute the package travel agreement.
2. The agreement is concluded as soon as the traveller accepts the  offer and the organiser confirms the booking in writing or  electronically. 
3. Before or at the time the agreement is concluded, the organiser  provides clear information about the destination, travel dates,  length of stay, accommodation, meals, activities, local transport,  group size, total price, payment arrangements, cancellation terms,  travel documents, insurance and insolvency protection. 
4. The traveller receives the agreement and confirmation on a durable  medium, such as a PDF file sent by email. 
5. The flight and other services not included in the package travel may  not be presented in the travel price or travel programme as if they  were provided by the organiser. 
6. The organiser participates in the GGTO Guarantee Scheme. Within  the limits of the GGTO Guarantee Scheme, the traveller may rely on  this guarantee if the organiser becomes insolvent and is unable to  fulfil its obligations under the package travel agreement. In such  circumstances, depending on the situation, the guarantee may  cover (part of) the prepaid travel amount and/or repatriation. 
7. To make a claim under the GGTO Guarantee Scheme, travellers  must submit their claim directly to GGTO in accordance with the  procedures and conditions published on the GGTO website. The  guarantee is subject to the applicable terms and conditions of the  GGTO Guarantee Scheme in force at the time of booking.
 

 
3. Booking details and special circumstances
1. The traveller must provide, in good time, accurate information  required for the performance of the trip, including their name,  contact details, emergency contact details and any relevant medical  or other special circumstances. 
2. The traveller must notify the organiser of any special requirements  before the agreement is concluded. The organiser may make  commitments only if they are recorded in writing in the agreement  or confirmation. 
3. The traveller must follow the reasonable instructions of the  organiser and local service providers and must behave as a  responsible traveller. In the event of serious disruption or nuisance,  the organiser may exclude the traveller from further participation in 
the trip. The resulting costs will be borne by the traveller to the  extent permitted by law.

 

4. Price and payment 
1. Before the travel agreement is concluded, the organiser will inform  you when the travel price must be paid in full. The organiser may  require a deposit. The amount of the deposit will be disclosed before  or at the time the travel agreement is concluded. If you have not  fulfilled your financial obligations by the time specified by the  organiser, you will be in default by operation of law.
2. If you are in default, the organiser will send a payment reminder  granting a period of fourteen days. The reminder will clearly state  that the agreement may be terminated if payment is not made and  that cancellation charges may be payable. Without such a clear  notice, no cancellation charges may be charged for late payment. 

 

5. Cancellation by the traveller 
1. The traveller may terminate the package travel before its  commencement. In the event of cancellation, the traveller owes an  appropriate and justified termination fee. 
2. For this trip, the following cancellation percentages of the travel  price apply, unless the organiser agrees otherwise with the traveller  in writing: 
• cancellation up to 120 days before departure: € 500,- non refundable deposit; 
• from 120 up to 61 days before departure: 50%; 
• from 60 up to 31 days before departure: 75%; 
• from 30 days before departure up to the day of departure, on the  day of departure or later: 100%. 
3. For the purposes of this article, the travel price means only the  price of the package travel offered by the organiser. The costs of  flights, insurance, visas and other external services booked  independently by the traveller are not included in these percentages  and must be cancelled by the traveller directly with the relevant  service provider. 
4. The termination fee reflects expected non-recoverable supplier and  administration commitments, cost savings and the chance of resale.  They will never exceed the appropriate and justifiable amount  allowed by law. 
5. If, before the start of the trip, unavoidable and extraordinary  circumstances occur at the destination or in its immediate vicinity  that significantly affect the performance of the package travel, the  traveller may terminate the agreement free of charge. The  organiser will reimburse the amounts paid for the package travel no  later than within fourteen days. In this case, the traveller is not  entitled to additional compensation. 

 

6. Transfer to another traveller 
1. The traveller may transfer the agreement, within a reasonable  period before departure, to another person who satisfies all the  conditions applicable to the trip. 
2. The traveller must notify the organiser of the transfer in writing.  The traveller and the person replacing them are jointly and  severally liable for the outstanding travel price and the reasonable  costs of the transfer. 



 

7. Changes or cancellation by the organiser 
1. The organiser has the right to change the travel agreement if it  concerns minor changes and if he has informed you in a clear,  understandable and prominent manner and in good time. The  traveller may not reject this change. 
2. Up to 20 days before departure, the organiser is entitled to increase  the price of the trip by a maximum of 8%, but only if the increase is  attributable to: 
• an increase in the cost of fuel; 
• an increase in the cost of other energy sources; 
• an increase in taxes; or 
• an increase in charges for the travel services included in the  agreement, imposed by third parties not directly involved in the  performance of the travel services, including tourist taxes, landing  charges and departure or arrival taxes in ports and/or at airports. 
• an increase in exchange rates relevant to the package travel. 
3. If, before the start of the trip, the organiser must significantly change a main characteristic of the package, cannot meet a special requirement expressly accepted in writing, or proposes a price increase of more than 8%, the organiser will inform the traveller promptly on a durable medium. The notice will explain the proposed change, any effect on the price, the reasonable period within which the traveller must respond, the consequences of not responding and, where applicable, any substitute package. The traveller may accept the change or terminate the agreement without paying a termination fee.
4. Whether a change is significant depends on its effect on the booking. Examples may include a substantial change to the dates, duration or destination; materially lower-standard accommodation; loss of the promised private en-suite room; a change to the women-only or small-group format; or removal of a material part of the included programme, meals or local transport. Changes to timings, the order of activities, suppliers or an activity replaced with a reasonably equivalent alternative will normally be considered minor. If the traveller terminates the agreement, all payments will be refunded within fourteen days. If an accepted change or substitute package is of lower quality or cost, the traveller is entitled to an appropriate price reduction.
5. The organiser is entitled to terminate the travel agreement in  writing within the period stated in the offer in the event that the  number of participants is smaller than the required minimum  number of participants made known prior to the booking. If the  traveller has made any (down) payments, the organiser will refund  the payments within fourteen days. 
6. If the organiser cancels the trip for a reason other than those stated in clauses 7.5 and 7.6, the traveller retains any statutory right to compensation.
7. The organiser cannot be held liable for the costs of a separate flight  booked by the traveller or any other service not included in the  package travel if the package travel is changed or terminated. 

 

8. Performance, non-conformity and liability 
1. The organiser ensures that the included travel services are  performed in accordance with the agreement. 
2. The traveller must report any non-conformity during the trip as  soon as possible to the organiser or the designated contact person,  so that the organiser can remedy the non-conformity. 
3. If an included service is not performed in accordance with the  agreement, the organiser will offer an appropriate solution or an  equivalent alternative at no additional cost, unless remedying the  non-conformity is impossible or entails disproportionate costs. 
4. In the event of non-conformity, the traveller is entitled, to the  extent provided by law, to remedy, an appropriate price reduction  and compensation. If a non-conformity has significant consequences  and is not remedied within a reasonable period, the traveller may  terminate the agreement free of charge. 
5. The organiser is not liable for non-conformities attributable to the  traveller, resulting from unavoidable and extraordinary  
circumstances, or caused by a third party not involved in the  performance of the included travel services. 
6. To the extent permitted by law, liability for damage other than  personal injury is limited to three times the package price. Liability  may not be excluded or limited where the damage consists of  personal injury or was caused by the organiser’s intentional or  negligent conduct.

 

9. Travel documents and insurance 
1. The traveller is responsible for having a valid passport or identity  document, visas, vaccination certificates and any other required  documents. The traveller must verify these requirements in good  time with the competent authorities and check before departure  whether the information is still up to date. 
2. The organiser strongly advises the traveller to take out suitable  travel insurance and cancellation insurance. The organiser does not  take out such insurance on behalf of the traveller unless otherwise  agreed in writing. 
3. The traveller is responsible for booking a flight that connects with  the programme and for the consequences of any delay, cancellation  or missed connection involving that flight. 

 

10. Assistance 
The organiser will provide assistance if you are in difficulty. This also  applies in the event of unavoidable and extraordinary circumstances as a  result of which the trip does not proceed in accordance with the  expectations that you may reasonably have based on the agreement. This  assistance consists of adequate information about medical services, local  authorities and consular assistance, as well as support with  communication and finding alternatives. The party responsible for the  circumstances giving rise to the need for this assistance will bear the  costs. 



11. Complaints 
1. The traveller must report complaints about the performance of the  trip without delay during the trip to the relevant service provider,  the designated contact person or the organiser directly. 
2. The traveller must give the organiser a reasonable opportunity to  resolve the complaint. 
3. If you fail to comply with the reporting obligation and/or fail to  register the complaint in the manner specified by the organiser, and  the service provider or organiser is thereby not given the  opportunity to remedy the non-conformity, your possible right to  compensation may lapse in whole or in part. 
4. If the complaint is not resolved during the trip, the traveller must  submit it to the organiser in writing and with reasons as soon as 
possible, but no later than two months after the end of the trip. The  organiser will respond within one month of receiving the complaint. 5. If you do not submit the complaint in time, the organiser may  decide not to deal with it, unless you cannot reasonably be blamed  for the delay. 



12. Insolvency protection 
1. Before the agreement is concluded, the organiser has informed the  traveller how protection against financial insolvency has been  arranged. 
2. The relevant guarantee scheme provides, in accordance with  statutory requirements, for reimbursement of amounts paid for  travel services that have not been performed and, where applicable,  for the continuation of the trip by another party. As the package  travel does not include international passenger transport, the  insolvency protection does not cover repatriation from the  destination.

13. Disputes and applicable law 

1. The agreement is governed by Dutch law, unless mandatory law of the country in which the traveller habitually resides provides otherwise. 

2. A dispute may be submitted to the court having jurisdiction under the law. No exclusive jurisdiction clause to the detriment of a consumer is agreed. 

3. The traveller’s statutory rights under package travel law may not be excluded or limited by these Terms.

Key rights under Directive (EU) 2015/2302  

  • Travellers will receive all essential information about the package before concluding the package travel contract. 

  • There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.  

  • Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organiser or the travel agent.  — Travellers may transfer the package to another person, on reasonable notice before and possibly subject to additional costs.  

  • The price of the package may only be increased if specific costs rise (for instance, fuel prices) and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8 % of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.  

  • Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package,  travellers are entitled to a refund and compensation where appropriate.  

  • Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.  

  • Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination  fee.  

  • If, after the start of the package, significant elements of the package cannot  be provided as agreed, suitable alternative arrangements will have to be offered  to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with  the contract and this substantially affects the performance of the package and  the organiser fails to remedy the problem.  

  • Travellers are also entitled to a price reduction and/or compensation for  damages where the travel services are not performed or are improperly  performed. 

  • The organiser has to provide assistance if the traveller is in difficulty.  

  • If the organiser or, in some Member States, the retailer becomes insolvent,  payments will be refunded. If the organiser or, where applicable, the retailer  becomes insolvent after the start of the package and if transport is included in  the package, repatriation of the travellers is secured. We have taken out  insolvency protection with the entity mentioned in the booking confirmation.  Travellers may contact this entity where applicable.
